They both had a drinking problem and neither had a vehicle, so they would call me to take them around. When I refused they got upset.
January 28th, 1991, I went to Florida on vacation and my wife stayed home at the Wyandotte house in Bartlesville, OK. On February 19th, 1991 I returned from Florida on the bus and Ralph, Gloria and her children were staying at the house. One evening their daughter, Alana, had volunteered to tell Grace and I a story about what happened to her with a baby-sitter when they lived in Norman, OK. That really upset me and I told Ralph and Gloria to move out the next day without any explanation and this really made them mad at us and they had to move in with my wife’s grandmother.
On January 19th, 1992 Grace and her mother went over to Gloria’s house to spend the weekend. Their 17 year old daughter got into a fight with Grace and gave her a black eye and ran her off. They kept her Nintendo, radio and other things and wouldn’t give them back. During the fight Grace had heard Alana say that “I should set-up your husband”. Grace testified that at trial. We got a detective to get her stuff back, this really made them mad at us.
It was right after this incident that Alana was having problems at school and was sent to Shadow Mountain Institute on February of 1992 where she said that I had raped and molested her back in December 26th, 1990 (Ct. 1); January 1991 (Ct. 2); and December 26th, 1991) (Ct. 3). I was arrested on April 10th, 1992.
I had two trials, at the first the jury received the instructions on corroboration, but at the second it wasn’t given to the jury, this was not fair because the victim made statements inconsistent with her testimony and she was not truthful.
So my case was based on the victim’s testimony ONLY, and it was up to the jury to decide their verdict ONLY ON WHO THEY WOULD BELIEVE, and not on any kind of physical evidence or DNA. Needless to say the jury believed the victim and found me guilty on all three counts and I got a total of 100 years in prison. I do not believe this was fair, because I always thought that a person had to be found guilty beyond a reasonable doubt by evidence or proof that a crime was committed, NOT on BELIEF that a crime was committed!
