Jack Barnes

Please let me start here. The sexual abuse in this case started at the foster home of Charles and Sherry Pierce in Owensville Ohio. While the foster mother was giving my daughter, Krista Barnes, a bath, she discovered blood inside her vagina, she then learnt that Krista’s brother Jack (aged 9) and Shawn (aged 7) were the ones that sexually abused Krista (aged 4) and that my youngest son Logan (aged 2) was not involved. This prompted Sherry Pierce to want to keep the children forever. Her plan was to coerce Jack and Shawn to say that their parents (Jack and Linda Barnes) and their two uncles (Ronald H Humfleet and Earl Barnes) sexually abused them and their sister.

No charges were ever filed against my sons and this evidence was not presented at the trial. Krista, Jack and Shawn did not testify on the witness stand. We were all convicted by a jury trial on the false testimony of our children, and given life sentences in the year 1984. We are innocent of this crime and have served the past 26 years in prison.

August 8^th 2009 - Newly Discovered Evidence

There is newly discovered evidence in the case at this time, a recanted testimony, and I, Jack Barnes the father, have an affidavit statement from Shawn Barnes - my son. It reads:

"I, Shawn Barnes, after first being duly cautioned and sworn according to the law, affirm and say that the following statements are true and correct.

Ion October 4^th I was born to Jack and Linda Barnes in Our Lady of Mercy Hospital at Mariemont ohio.

Now I am compelled to tell the truth of this situation to whoever will listen. When we went to trial I testified twice on the witness stand and so did my brother Jack. We testified once against our father and once against our mother. Under the pressure and confusion of the situation I testified under oath that I had been sexually abused and raped by my father and my two uncles, Ronald H Humfleet and Earl Barnes. I testified against my mother during her trial that I had been by her. I also testified that my mother watched while I was raped by my father and uncles. All of these statements are false and untrue. I have never, under any circumstances, been taped by my parents or my uncles. I have not been wrongfully touched or molested by anyone in my family. The did not beat me or subject me to any kind of outlandish acts, but there was absolutely no physical or sexual abuse by anyone in the Barnes or Humfleet families. It is important that I make perfectly clear that there ideas of sexual and physical abuse by my parents and uncles were the product of Mrs Sherry Pierce and were created inside of the Pierce foster home. These ideas were corroborated by my brother Jack and me to the police, and Sherry Pierce used severe abuse and coercion to solidify our statements.

My other Uncle, Earl Barnes, passed away while incarcerated. I would like to see a just outcome for the three who still live. I believe their wish, like all who are wrongfully imprisoned, would be that whoever knows the truth of their innocence would come forward. I do so no, not under duress but of my own free will.
