The detectives in the case were never told this and the jury found Jose guilty. However, the jury was ‘hung’ for a period of time and because of this the Prosecutor offered Jose a two year plea-bargain if he’d admit guilt, which he did not do because he was innocent. After the verdict of ‘guilty’ the Judge sentenced Jose to 18 years in prison.
Jose had broken his relationship off with his girlfriend who had cheated on him. The situation became very serious when Jose found another woman (Teresa) who is now his wife. His ex-girlfriend went crazy, threatening to do bizarre things to get him to go back to her. One time, she went to Jose’s home to confront them and sliced her wrist blaming Jose for doing it in an attempt to have him arrested. She then hired an Attorney (Lee F Burrows) to try to get a protective order against Jose but failed and the Judge told her she was “a crazy woman”. Attorney Burrows testified at Jose’s trial that the woman, in his opinion, had lied about Jose. Then, another time, she and her brother Carlos Castillo, burgled Jose’s home trying to steal everything from him and his new wife and were arrested for it; when Jose still refused to go back to her, her and her brother kidnapped Jose’s sister’s daughter (Nancy Perez) drugged the poor little 14 year old girl and then had her brother Carlos sexually assault her. Nancy woke-up at Carlos’ sister’s home with blood running down her legs. They were both arrested and charged with Aggravated Kidnapping - Jose has a copy of the indictments.*  His ex- girlfriend was constantly threatening Jose that she would find a way to destroy him and his relationship with his new wife Teresa, and she finally did by getting her daughter to falsely accuse him of sexual assault. It may be that the girl was sexually assaulted but she had named Alex and not Jose. That’s when the truth was twisted and Jose’s name was used by the ex-girlfriend and her family; a family who participated in the sexual assault of Jose’s niece, whom when she awakened and saw the blood was told by Carlos’ sister that it was from Carlos sexually assaulting her because he’d said he was going to do it - apparently, she knew about it before it happened but did nothing to try and stop it. Once they were able to get Jose arrested they took his property and his pick-up truck worth about $10,000.

Jose requests financial assistance, or donations to help him prove his innocence. He needs the help of a highly skilled Appeals Attorney to overturn his conviction and a Detective to investigate the Castillo family and the girl’s fabricated story. Wrongly Convicted Of: Aggravated Sexual Assault - Child
Sentenced To: 18 Years Imprisonment
Jose is a 29 year old Mexican Nationale who does not understand the English language or the legal principles that affected his conviction and sentence. His case stems from allegations that he sexually assaulted his ex-girlfriend’s daughter, Dora Alcoser, when she lived with them, which is untrue because she never lived with Jose. The Paediatrician who examined the girl in January of 2004 found no compelling evidence. The Prosecutor could not extract a guilty plea-bargain from Jose and so the case proceeded to a jury trial. The only evidence the Prosecutor had was from three witnesses - the girl’s mother, an aunt and her grandmother who claimed the girl had told them Jose had raped her but, at first named a former boyfriend of the aunt “Alex” but then later changed it to Jose.
