Mark Evans Pipkin
My name is Mark Evans Pipkin TDJC, #1473770. In 2005 I was charged with two counts of ‘Sexual Assault of a Child’ and two counts of ‘Aggravated Sexual Assault of a Child’. I went to trial in November of 2007. I took the two counts of Sexual Assault of a child to trial and was found guilty. I told my attorney that I wanted to appeal the decision and he told me he had a friend that would help me. I told him that I did not have any more money and he told me that the only choice I had was to plead guilty and get all four cases to run concurrent; now he is saying that he never told me this. He manipulated and scared me into taking the plea bargain. My attorney told me how to answer the judge’s questions before we went up to the bench. My lawyer told me that if I took the other two cases to trial I would lose and never get out of prison.

The two girls had a rape test done which came back ‘negative’ as far as body fluid being mixed. My wife and my body fluid was mixed but not the girls. I adopted my wife’s three kids in 1999. My attorney did not get with a doctor before the trial to question him about sexual assault victims, and had to question the person who done the tests on the girls, and only asked a few questions. He was not knowledgeable in the forensics of sexual assault victims. I was turned in two times prior to CPS, but cleared of wrongdoing both times. My attorney did not get the CPS paperwork or preview the CPS tape prior to trial; he had to ask the judge to allow him time to watch the tape. The oldest girl’s testimony did not match the tape on some things and to my knowledge my attorney did not question her about that.

One of the detectives went to school with my sister. I told my attorney that I knew some of the detectives’ family members and had a disagreement with one of them. My attorney told me that it did not matter. I told my attorney that I thought it would be a conflict of interests.

My attorney did not call any witnesses on my behalf to testify for me. He told me that it would confuse the prosecution if he did not. My attorney did call my witnesses for my sentencing but, like I said, I was scared into taking a plea bargain and now I am trying to appeal my case. I was denied by the District Appeals Court.and have my Habeas Corpus 11.07 in the courts now.

I did not do what I am accused of doing and need help to prove my innocence. I cannot afford an attorney to help me. I am 37 years old and have never been in trouble before these charges. My wife, Mary Pipkin and I were talking about divorce and custody of the kids several months prior when she got a letter from an attorney. My wife, who sent her last husband to jail so she would have an easy divorce; he was charged with almost the same as she had her kids charge me with.
