
On February 2nd 2005 I was convicted by jury on both counts. A professional medical expert informed the jury (state witness) that the alleged victim’s physical exam was normal “no signs of sexual battery".
2001, both mother and daughter wrote letters to an attorney in Georgia in which her and a man (who also testified against me) paid $3,000.00 and got me out of jail on probation violation; paid $1,000.00 on my restitution; told the law that I had never done anything bad to her or her mom and mom stated the same.
September 10th 2002, I was investigated for alleged sexual assault on the same girl, both denied allegations and the case was dismissed. I left this woman the same day because I found out she was married - both begged me not to leave. On September 30th 2002, she calls the police and tells them that I sexually assaulted her daughter.
At the trial on February 2nd 2005, the mom admits she lied and the alleged victim admits that after I left she called the police. Handwritten letters and official police reports state that I did not commit this crime, as does a doctor. The state used a prior conviction to give me life without parole.
Appeal courts, post conviction relief and state supreme court appellate defense states LWOP is unconstitutional. DNA was negative, physical examination was ‘normal’. Eight years and I am still incarcerated for a crime I did not commit. Please don’t let an innocent man die in prison. If I had broken the law then ‘yes’ prosecute to the fullest, but a man should not be prosecuted when there is no evidence, or proof, that he committed a crime.
