Justice denied! Man convicted of felony evading and other charges stemming from a police pursuit in 2001 believes he's the victim of a cover-up. He is seeking a new trial on the basis of ineffective defense counsel and questionable police tactics.

Los Angeles CA - On March 22, 2001, two Los Angeles Police Department (LAPD) officers stopped 49 year old Raynell Carmichael’s vehicle in southeast Los Angeles for an inoperable right rear stop lamp at 4.24 p.m. Identification and background checks on Carmichael and a female passenger returned no wants, warrants, or restraining orders against either of them, but did indicate that Carmichael was on parole for robbery.

Several minutes had passed without either of the officers writing a citation for the inoperable right rear stop lamp when one of the officers received a radio call advising him that back-up units and an air ship were being sent to their location.
The officer who received this radio call immediately drew his weapon, telling the female passenger to put her hands on the dashboard and Carmichael to get out of the vehicle.

Sensing something was wrong, and fearing that he was about to be shot or killed in the isolated area where had had been stopped, Carmichael started his car and quickly sped away from the traffic stop scene east bound on 107th Street towards Wilmington Avenue.

Initiating en emergency vehicle pursuit at 4.37p.m., the officers advised the Southeast Division watch commander that they were in pursuit of a possible murder suspect, instead of a fleeing felon or parolee. Although Carmichael’s vehicle being spotted south bound on the 605 freeway by a Los Angeles Sheriff Officer traveling in the opposite direction at 5.25p.m., these officers reported Carmichael’s vehicle as being located at 105th Street and Graham Avenue. In doing so, they intentionally associated the license number of the vehicle that Carmichael was driving with a previous call they had been on earlier at 3.37p.m. That call, involved a stolen vehicle and murder suspect located in the 2200 block of east 105th Street. Then, at 5.31p.m., a third LAPD officer from the Southeast Division’s vice squad, advised pursuing units that Carmichael was a suspect wanted for a murder.

As Carmichael continued to drive while being pursued by numerous law enforcement units from various agencies, he became aware of the fact that he was now falsely accused of being a murder suspect. Ironically, the officer who had performed the identification and background checks on Carmichael did nothing to correct this information, allowing it to be disseminated to all of the pursuing ground and air units, as well as to the news media, until after the conclusion of the pursuit in Long Beach outside of a relative’s home.

After his subsequent arrest, Carmichael repeatedly asked one of the officers about the radio call sending back-up units and an air ship to the officer’s location where they had stopped him, only to be told that there was such a call, but it was not for him.

This was not an emergency vehicle pursuit to apprehend a fleeing felon or parolee. This was nothing more than a police vehicle pursuit and manhunt with the intent to kill an individual who was purposely and falsely accused of being a 187 murder suspect associated with a prior call involving a stolen red 1987 Nissan that had nothing to do with Carmichael, or the blue 1990 Toyota he was driving whatsoever.
