There was evidence withheld from the Defense by the State, Police Department and the State Crime Lab that was pertinent to the Defense to impeach the Prosecuting Attorney, Detectives and State Witnesses. One of my Public Defenders stayed on the same street as the deceased. The prosecutor committed perjury by giving false testimony to the court in order to secure a conviction of evidence that never existed and violated its plea agreement by amending already executed information while my Public Defenders sat back in silence and said nothing.
The Judge illegally added the word ‘intent’ to the information to show ‘purposefully’. My case was racially profiled by the media and I never had a chance of getting a fair trial and there was a conspiracy in order to get a conviction. There were never any surveillance camera photos of me walking up an alley, or dumping trash, or putting something in the trunk of a car. Also, there was a report made by Det. Keith Cockrell with regards to getting a pair of boots supposedly with blood on them, to this day nobody has seen said boots. These boots were sent to the State Crime Lab to be tested for hair fiber, which was inconclusive, the boots were later tested for DNA and this is when one drop of the deceased's blood was found on the top right boot; these boots were never shown to anybody for identification and were withheld by the police.
I witnessed Mr. Artemakis getting into several heated arguments prior to this incident and on one occasion he had a knife in his hand. I had reason to fear him because of his behavior towards employees, customers and me. He would throw pots on the floor and use racist remarks against me.
I tried to go around Mr. Artemakis to put two dippers on the wall and he pushed me and was pushed back causing him to land on a table. He grabbed a knife and charged me stating “I’m going to kill your nigger ass”. We tussled over the knife which resulted in Mr. Artemakis getting stabbed several times and dying instantly. I never meant to hurt Mr. Artemakis, I was trying to keep him from hurting me. I never took any money from him, or the business, and just panicked thinking nobody would believe me without any witnesses to the offense. I insisted on going to trial but my Public Defenders scared me out of it. The State’s Evidence doesn’t support the charge of Capital Murder.

I was arrested on 04-09-02 by warrant issued 04-01-02 for 1st Degree Murder of Mr. Artemakis, which I pled not guilty to at my first court appearance on 04-10-02 by means of self-defense. On 05-24-02 the State illegally charged me again with Capital Murder, Agg. Robbery and Theft of Property by felony information. There was no Amended Indictment or Information Order granted by the court nor did the prosecution seek leave of the count. Plus there was nothing noted in the record of this charge.
My Public Defenders had my case for a year-and-a-half and never investigated any evidence or interviewed any witnesses of the State or on behalf of the Defense. They only discussed taking a plea bargain and constantly threatened my family and me with the death penalty if I did not take the plea of ‘Life without Parole’.
